Alberta realtor’s licence cancelled after sexual assault allegations

The Real Estate Council of Alberta (RECA) has permanently cancelled the licence of Alberta realtor Justin James Fraser for violations of the Real Estate Act.

A hearing panel found Fraser broke s.42(f) of the act on four occasions.

The section states “licensees must not physically, sexually, emotionally or verbally abuse a client, customer, licensee or party to [their licensed practice].”

Fraser was accused of inappropriate conduct with a client on four separate occasions between March 9 and July 6, 2019.

At the time of the alleged offences he was with Logic Realty Inc. O/A Logic Realty.

On one occasion he allegedly touched and engaged in sexual acts with the client without her consent on a drive to Vegreville.

On a different occasion he was accused of exposing his body to the same client in a video call.

Fraser was represented by counsel for three of the four dates of the hearing, which happened in 2023.

In its decision released on Dec. 20, 2024, the Hearing Panel found the registrar for RECA had proven all four allegations on a balance of probabilities and found Fraser worthy of sanctioning.

His licence was cancelled effective Dec. 20.

He was also ordered to pay $17,950 in legal costs to RECA.

Prior to the lifetime cancellation of his licence, RECA suspended Fraser’s licence on Oct. 5, 2021, pending the outcome of the hearing.

A sexual assault charge against Fraser was withdrawn, the Alberta Court of Justice told CTV News Edmonton.
