Calgary constable testifies at his sexual assault trial

A jury trial is underway in Calgary for a police officer charged with sexual assault.

The allegations against Const. Brandon Kan, a six-year member of the CPS, stem from an off-duty incident in 2020.

The female complainant can’t be identified due to a publication ban.

On Thursday, Kan, 33, testified the sex he had with the woman was consensual.

He said he was introduced to the woman through a mutual friend and after exchanging texts over several weeks, the pair had a date at his house in October 2020.

He said after dinner, wine and conversation, they began kissing in his kitchen before he asked her to go up to his bedroom, which she agreed.

Kan said while having sex he slapped the woman in the face “playfully.”

He also said he applied “slight pressure” to her neck with his hand and told the woman to tap his hand when she wanted him to stop.

Kan said this was repeated several times.

He told the jury it was meant to “enhance the sexual experience” and “not meant to hurt her or make her feel uncomfortable.”

Victim said sex was assault

The woman said while she initially consented to have sex with Kan, she did not agree to several of the acts he performed on her.

She told the court Kan forced her face into his crotch and gagged her.

She said he held his forearm forcibly against her neck, and wound up his arm to slap her several times in the face.

The woman attended the Sheldon M. Chumir Centre three days after meeting with Kan.

On Wednesday, a doctor, who is a member of the Calgary Sexual Assault Response team testified about her examination and the alleged victim’s sexual assault evidence kit, or what is known as a rape kit.

Dr. Mahjabeen Hussain testified to redness of the eyes, redness and tenderness to the woman’s neck and dark bruising to other parts of her body.

Defendant shocked by allegations

Kan denied he caused the bruising.

He said the woman spent the night and they kissed before she left in the morning, and he was shocked to learn about the allegations against him.

He said he approached his supervisor with the CPS after learning of them and told him, “Sgt. I think I’m in trouble.”

“I wanted to be upfront and honest I have nothing to hide,” he told the jury.

Kan was charged in 2024 following an investigation from Alberta’s police watchdog, the Alberta Serious Incident Response Team (ASIRT).

A video of ASIRT’s interview with Kan was played in court Thursday.

In it, he told officers the pair had not talked about their sexual preferences before they had sex but said the woman was moaning and grabbing onto the sheets.

“She never showed at any point she didn’t enjoy it,” he told investigators.

In 2024, ASIRT determined it found “reasonable grounds to believe an offence had occurred” and the Crown determined evidence met the standards for prosecution.

Kan remains suspended with pay.

The CPS says his duty status will be reviewed at the conclusions of his court proceedings.
